If you purchase a product or service for a minor, you represent that you are the minor’s parent or legal guardian or otherwise have authority to make the purchase on their behalf.

However, we do not guarantee that all website information will always be complete, current, or error-free.

Product colors, appearance, specifications, and packaging may vary from images displayed online.

Aeriv may correct errors, update information, cancel orders, or modify product listings when necessary.

5. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated.

Applicable taxes, shipping fees, rental deposits, service charges, or other fees may be added during checkout.

Payment is due at the time of purchase or booking unless otherwise agreed in writing.

Aeriv reserves the right to:

  • Correct pricing errors

  • Change pricing at any time

  • Cancel orders placed at an incorrect price

  • Require additional verification for suspicious or high-risk transactions

6. Orders

An order confirmation does not necessarily constitute final acceptance of an order.

Aeriv may cancel or refuse an order for reasons including:

  • Product unavailability

  • Pricing errors

  • Suspected fraud

  • Payment authorization problems

  • Shipping restrictions

  • Inventory discrepancies

  • Violation of these Terms

If Aeriv cancels a paid order, the amount charged for the canceled item will be refunded.

7. Returns and Refunds

Product returns and refunds are governed by Aeriv’s current Return & Refund Policy.

Rental reservations, bike fitting appointments, consultations, services, and consignment transactions may have separate cancellation or refund terms.

Where a product or service has its own specific terms, those terms control over the general return policy.

8. Rental Services

Aeriv may offer rental equipment including wetsuits, bike travel cases, tools, and other cycling or triathlon equipment.

By renting equipment from Aeriv, you agree that:

  • You are responsible for the equipment during the entire rental period.

  • Equipment must be returned by the agreed return date and time.

  • Equipment must be returned in substantially the same condition in which it was provided, excluding reasonable normal wear.

  • You are responsible for loss, theft, misuse, excessive damage, or destruction of rented equipment while it is in your possession.

  • You will use rented equipment only for its intended purpose.

  • You will follow any instructions provided by Aeriv.

  • You will not modify, alter, disassemble, or repair rented equipment unless specifically authorized.

Aeriv may charge the payment method on file for:

  • Late fees

  • Missing components

  • Excessive cleaning

  • Damage

  • Replacement costs

  • Unreturned equipment

  • Other amounts permitted under the applicable rental agreement

Replacement costs may be based on the current retail replacement value of the item or a comparable replacement product.

9. Wetsuit Rentals

Wetsuit fit varies by manufacturer, model, athlete dimensions, and personal preference.

Aeriv may provide sizing recommendations but does not guarantee that a particular wetsuit size will fit every customer.

Customers are encouraged to try on rental wetsuits before use whenever possible.

Rental wetsuits may include different brands or models depending on inventory availability.

The customer is responsible for inspecting the wetsuit before use and notifying Aeriv of any existing damage.

Damage caused by fingernails, sharp objects, improper dressing techniques, heat exposure, misuse, or other negligent handling may result in repair or replacement charges.

10. Bike Travel Case Rentals

Customers renting bike travel cases are responsible for properly securing and transporting their bicycles unless Aeriv has specifically been hired to provide packing services.

Aeriv is not responsible for damage caused by:

  • Airlines

  • Baggage handlers

  • Transportation companies

  • TSA or security inspections

  • Improper handling after the case leaves Aeriv

  • Improper packing performed by the customer or another third party

Aeriv does not guarantee that a travel case will prevent all bicycle damage.

Customers are responsible for complying with airline baggage rules, weight restrictions, insurance requirements, and transportation regulations.

11. Bike Packing and Rebuilding Services

When Aeriv provides bike packing, assembly, or rebuilding services, Aeriv will perform the work using reasonable professional care.

Customers are responsible for informing Aeriv of:

  • Existing damage

  • Unusual components

  • Proprietary hardware

  • Previous repairs

  • Known mechanical problems

  • Non-standard installation requirements

Some bicycles may require replacement parts, additional labor, or manufacturer-specific procedures.

Any additional charges will be communicated when reasonably possible.

Customers should inspect and test their bicycle after transportation and before racing or riding.

12. Bike Fitting

Bike fitting is intended to improve rider positioning, comfort, efficiency, aerodynamics, and/or performance based on the information available during the fitting session.

Bike fitting results are inherently individualized.

Aeriv does not guarantee:

  • Elimination of pain or discomfort

  • Prevention of injury

  • A specific aerodynamic improvement

  • A specific power increase

  • A specific race result

  • A specific performance outcome

The customer is responsible for accurately disclosing relevant information that may affect the fitting process.

Bike fitting is not medical treatment and is not a substitute for evaluation or treatment from a licensed physician, physical therapist, or other qualified healthcare professional.

If you experience pain, numbness, weakness, or other concerning symptoms, you should seek appropriate medical care.

13. Bike Fit Equipment and Adjustments

Some bike fitting recommendations may require changes to components or equipment.

Recommended changes may include:

  • Saddles

  • Stems

  • Aerobars

  • Crank lengths

  • Cleats

  • Pedals

  • Shoes

  • Insoles

  • Risers

  • Extensions

  • Other positioning equipment

Unless explicitly included in the fitting package, replacement products, components, installation labor, and follow-up work may involve additional charges.

Aeriv cannot guarantee that every recommended position can be achieved on every bicycle because of component, frame, compatibility, or adjustment limitations.

14. Consultations and Nutrition Guidance

Any race-day nutrition, hydration, fueling, equipment, or performance guidance provided by Aeriv is intended for general educational and performance-planning purposes.

Aeriv does not provide medical diagnosis or medical nutrition therapy unless explicitly stated and provided by an appropriately licensed professional.

Customers with medical conditions, allergies, dietary restrictions, gastrointestinal conditions, or other health concerns should consult an appropriate healthcare professional before making significant changes to nutrition or hydration practices.

Individual responses to nutrition products and strategies may vary.

15. Athletic Activity and Assumption of Risk

Cycling, triathlon, swimming, running, racing, equipment transportation, mechanical work, and related activities involve inherent risks.

These risks may include serious injury, property damage, disability, or death.

By using Aeriv products, rentals, recommendations, or services, you acknowledge that participation in endurance and cycling activities involves risks that cannot be entirely eliminated.

You are responsible for determining whether equipment, activities, and recommendations are appropriate for you.

You should inspect equipment before use and stop using any equipment that appears unsafe or damaged.

16. No Guarantee of Performance

Aeriv may provide equipment, fitting, aerodynamic, nutrition, or performance recommendations intended to help athletes improve.

However, Aeriv makes no guarantee regarding:

  • Race outcomes

  • Speed improvements

  • Power improvements

  • Aerodynamic savings

  • Injury prevention

  • Qualification for races

  • Personal records

  • Athletic performance

Actual results depend on many factors outside Aeriv’s control.

17. Consignment Services

Aeriv may facilitate the sale of bicycles, equipment, apparel, components, or other goods owned by third parties.

Consignment products may be used and are generally sold in their existing condition.

Unless otherwise specifically stated:

  • Consignment merchandise is sold as-is.

  • Used merchandise may show signs of wear.

  • Customers are responsible for inspecting consignment merchandise before purchase.

  • Aeriv does not guarantee the remaining useful life of used products.

  • Manufacturer warranties may not transfer to subsequent owners.

Separate consignment agreements may govern the relationship between Aeriv and the seller.

If a separate consignment agreement conflicts with these Terms, the specific consignment agreement controls.

18. Used Equipment

Used bicycles, components, wheels, accessories, and equipment may have wear that is not immediately visible.

Aeriv may perform reasonable inspections but cannot guarantee that every issue will be discovered.

Customers purchasing used equipment accept the risks inherent in purchasing previously owned products.

19. Manufacturer Warranties

Some products sold by Aeriv may include warranties provided by the manufacturer.

Manufacturer warranty decisions are controlled by the manufacturer and not Aeriv.

Aeriv may assist customers with warranty claims when appropriate but cannot guarantee that a manufacturer will approve a claim.

Warranty claims may require:

  • Proof of purchase

  • Photos

  • Serial numbers

  • Inspection

  • Return of the product

  • Additional information requested by the manufacturer

20. Rental and Service Cancellations

Rental reservations and service appointments are subject to the cancellation policy displayed at the time of booking.

Different services may have different cancellation, rescheduling, or refund requirements.

Customers are responsible for reviewing the applicable cancellation policy before confirming a reservation.

21. Appointment Timing

Customers are responsible for arriving on time for scheduled appointments.

Late arrival may reduce the amount of time available for a service and may not result in a reduced price.

Aeriv may require an appointment to be rescheduled if the customer arrives too late to reasonably complete the service.

Applicable rescheduling fees may apply.

22. Shipping

Shipping times are estimates and are not guaranteed unless explicitly stated.

Aeriv is not responsible for delays caused by circumstances outside its reasonable control, including:

  • Carrier delays

  • Customs or regulatory delays

  • Theft after confirmed delivery

Customers are responsible for entering accurate shipping information.

23. Local Pickup

Orders designated for local pickup must be collected according to the pickup instructions provided by Aeriv.

Aeriv may require photo identification, order confirmation, or other verification before releasing an order.

Aeriv reserves the right to refuse release of an order when fraud or unauthorized pickup is suspected.

24. Intellectual Property

All Aeriv branding, logos, website design, photographs, graphics, text, product descriptions, service descriptions, and other original content are owned by or licensed to Aeriv unless otherwise stated.

You may not reproduce, distribute, modify, sell, or commercially use Aeriv intellectual property without prior written permission.

Aeriv is not responsible for the availability, security, privacy practices, or content of third-party services.

Your use of those services may also be subject to their own terms and privacy policies.

26. Promotions and Discount Codes

Promotions and discount codes may be subject to additional terms.

Unless otherwise stated:

  • Promotions cannot be combined.

  • Discount codes have no cash value.

  • Discounts cannot be applied retroactively.

  • Promotions may exclude certain products or services.

  • Aeriv may end or modify promotions at any time.

Aeriv may cancel orders involving misuse, unauthorized reproduction, or abuse of promotional offers.

27. Fraud Prevention

Aeriv may use fraud-detection tools and transaction screening.

Aeriv may request additional verification before completing an order, including proof of identity or confirmation of billing information.

Orders suspected of fraud, payment abuse, resale fraud, chargeback abuse, or unauthorized activity may be canceled.

28. Limitation of Liability

To the fullest extent permitted by applicable law, Aeriv will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Aeriv products, services, rentals, website content, or recommendations.

This includes, where permitted by law, losses related to:

  • Lost race entries

  • Personal property loss

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

  • Your violation of these Terms

  • Your misuse of rented equipment

  • Your unlawful use of Aeriv.com

  • Your negligent or intentional acts

  • Your violation of another person’s rights

30. Disclaimer of Warranties

Except for warranties expressly provided in writing, Aeriv products, services, website content, and recommendations are provided on an “as available” and “as-is” basis to the fullest extent permitted by law.

Aeriv does not guarantee that the website will always be uninterrupted, secure, or error-free.

Nothing in this section limits any consumer rights that cannot legally be waived.

Aeriv will not be responsible for delays or failure to perform caused by events outside its reasonable control.

These may include:

  • Natural disasters

  • Wildfires

Existing confirmed bookings will generally remain subject to the terms in effect when the reservation was made unless otherwise agreed.

33. Changes to These Terms

Aeriv may update these Terms periodically.

The current version will be posted on Aeriv.com with an updated effective date.

Continued use of Aeriv.com after revised Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

34. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any dispute arising from these Terms or Aeriv services will be handled in an appropriate court located in Colorado unless applicable law requires otherwise.
